Terms of Service

Welcome to BcauseU. By accessing or using our website and services, you agree to be bound by these Terms of Service. Please read them carefully before placing an order.

1. Overview
BcauseU creates original, personalized songs commissioned by our customers. When you purchase a custom song from our store, you are commissioning a unique song created to your specifications. A physical keepsake (the Keepsake Magnet) may accompany your order depending on the option you select. We also offer Your Song keepsakes, where you provide a recording you own and we reproduce it on a Keepsake Magnet; additional terms for those orders are in Section 9.

2. Products and Services
All songs created by BcauseU are original and made specifically for each customer. As part of your order, you'll complete a short survey sharing the personal details, stories, and preferences that guide the creation of your song. Creation begins once your survey is submitted.

3. Pricing and Payment
All prices are listed in US Dollars (USD) and are subject to change without notice. Payment is due at the time of purchase. We accept major credit cards and other payment methods as displayed at checkout.

4. Order Process
Once your order is placed and your survey is submitted, we begin creating your song. Your digital song typically arrives about 7–10 days after your survey. If your order includes the Keepsake Magnet, the physical keepsake typically arrives about 3–4 weeks after your survey, with the song delivered digitally first. You'll be notified by email when your song is ready and when any physical item has shipped.

5. Intellectual Property
Your song is yours to enjoy — you're free to use, play, and share your song however you like. By placing an order, you agree that BcauseU may use portions of the songs we create in our social media, advertising, and marketing content. This marketing permission does not apply to recordings you provide for a Your Song keepsake (see Section 9). BcauseU retains ownership of its brand, trademarks, logos, and website content.

6. Revisions
Each order includes one complimentary lyrics revision. Once we send your lyrics, you have 24 hours to request changes. If we don't hear from you within that window, we'll finalize the lyrics as written and begin creating your song. If you miss the window, email help@bcauseu.com and we'll do our best to help.

7. Refunds and Cancellations
Please refer to our Return and Cancellation Policy for detailed information about cancellations, refunds, and our revision process.

8. User Conduct
You agree not to use our services for any unlawful purpose or to request content that is defamatory, obscene, or infringes upon the rights of any third party. BcauseU reserves the right to decline any order at our discretion.

9. Your Song Keepsakes (Customer-Provided Recordings)
These terms apply when you order a Your Song keepsake and upload your own recording, photo, title, or other content ("Your Content").

9.1 What you're telling us. By uploading Your Content, you represent and warrant that: (a) you own Your Content or have all rights, licenses, and permissions needed for us and our manufacturing partners to copy it onto a keepsake and deliver it to you; (b) Your Content is not a commercial release and does not include any music, recording, artwork, or photo owned by anyone who hasn't given you that permission; (c) every person whose voice, image, or name appears in Your Content has consented to its use; and (d) Your Content is lawful and does not violate anyone's privacy, publicity, or other rights.

9.2 Your responsibility. You are solely responsible for Your Content. You agree to defend, indemnify, and hold harmless BcauseU LLC and its owners, and our manufacturing and fulfillment partners, from any claim, loss, or expense (including reasonable attorneys' fees) arising from Your Content or from a breach of the warranties above.

9.3 Our right to decline. We screen recordings before they are made, and we may decline, hold, or cancel any Your Song order at any time, for any reason, including if we can't verify your rights, if the recording appears to be a commercial release, or if the content is unlawful or objectionable. If we decline your order before it's made, we'll refund you in full. We may also ask you for a short explanation or supporting documents before we proceed.

9.4 No duty to screen. Our review is for our own protection and doesn't shift responsibility for Your Content to us. We don't promise to catch every problem, and our decision to make a keepsake is not a determination that you have the necessary rights.

9.5 License to us. You grant BcauseU and our manufacturing partners a limited, non-exclusive license to store, copy, and reproduce Your Content solely to make, replace, and deliver your keepsake and to handle your order. We don't acquire any other rights in Your Content.

9.6 Reports. If you believe a keepsake reproduces your work without permission, contact us at help@bcauseu.com with the details described in 17 U.S.C. §512(c)(3). We act on credible reports promptly and decline further Your Song orders from customers who provide infringing content.

9.7 Age. You must be 18 or older to place a Your Song order.

9.8 Retention. We keep the recording and photo you upload for 90 days after your keepsake is delivered (so we can replace it if it arrives damaged), then delete them from our systems and ask our manufacturing partner to do the same. We keep a record of your order — including your confirmation that you had the right to use the recording — for as long as we need to for legal and accounting purposes. You can ask us to delete your files sooner at help@bcauseu.com.

10. Limitation of Liability
BcauseU shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services. Our total liability shall not exceed the amount you paid for the specific product or service giving rise to the claim.

11. Changes to Terms
We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after any changes constitutes acceptance of the revised terms.
